On 14 February 2025, the European Securities and Markets Authority (ESMA) launched, in accordance with the announcement hereafter, a Common Supervisory Action (CSA) with National Competent Authorities (NCAs) on Compliance and Internal Audit Functions of UCITS Management Companies (“UCITS Managers”) and authorised Alternative Investment Funds Managers (“AIFMs”) across the European Union.

Dans un communiqué du 15 janvier 2025, la CSSF indiquait qu’elle notifierait les entités financières identifiées comme celles qui, conformément à l’article 5, paragraphe 5 des normes techniques de règlementation (RTS)1, ne peuvent pas être exemptées de déclarer un incident majeur pendant les week-ends et les jours fériés alors que le délai de soumission de notification de cet incident expire un jour de week-end ou un jour férié. Cette notification de la CSSF aux entités financières concernées devait avoir lieu avant la fin du mois de février.

In a communiqué dated 15 January 2025, the CSSF indicated that it would notify financial entities identified as those which, in accordance with Article 5(5), of the regulatory technical standards (RTS)1, cannot be exempted from reporting a major incident during weekends and bank holidays when the time limit for submitting notification of that incident falls on a weekend day or a bank holiday. This notification by the CSSF to the financial entities concerned was to have taken place before the end of February.
